Terms of Service

These Terms of Service ("Terms") govern your use of the ChatBotAPP platform ("Service") operated at app.chatbotapp.rs. By registering for an account or using the Service, you agree to be bound by these Terms.

1. Service Description

ChatBotAPP is an AI-powered chatbot platform that enables businesses to create, deploy, and manage intelligent chatbots across multiple communication channels. Our Service includes:

  • AI chatbot creation and customization powered by large language models
  • Multi-channel deployment (website widget, WhatsApp, Viber, Instagram, Facebook Messenger, email)
  • Knowledge base management (documents, FAQs, website crawling)
  • Integration with Google Calendar and Google Sheets for booking and data management
  • Voice capabilities (speech-to-text and text-to-speech)
  • Analytics and conversation insights
  • Booking and appointment scheduling automation

2. Account Registration

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • One person or entity may maintain multiple chatbot agents under a single account

3. Free Trial & Subscription Plans

3.1 Free Trial

  • New accounts receive a 7-day free trial with no credit card required
  • Trial includes access to core features with limited message credits
  • At the end of the trial, you must subscribe to a paid plan to continue using the Service

3.2 Paid Plans

  • Subscription plans are billed monthly in EUR
  • Each plan includes a specified number of message credits and features
  • Message credits are calculated based on AI tokens consumed
  • Unused message credits do not roll over to the next billing period
  • You may upgrade or downgrade your plan at any time

3.3 Payment & Invoicing

  • Invoices are generated at the beginning of each billing cycle
  • Payment is due within the period specified on the invoice
  • Failure to pay may result in suspension or termination of your account

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Send spam, unsolicited messages, or engage in abusive messaging practices
  • Distribute malware, viruses, or harmful content
  • Impersonate another person or entity
  • Collect personal data from end-users without proper legal basis or consent
  • Create chatbots that provide medical, legal, or financial advice without appropriate disclaimers
  • Generate content that is illegal, hateful, discriminatory, or promotes violence
  • Attempt to bypass usage limits, rate limits, or security measures
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell or redistribute access to the Service without our written authorization

5. Your Content & Data

5.1 Ownership

You retain all rights to the content you upload to the platform, including knowledge base documents, custom instructions, and business data. We do not claim ownership of your content.

5.2 License to Us

By uploading content, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service. This includes sending content to third-party AI providers (such as OpenAI) to generate chatbot responses.

5.3 Your Responsibility

  • You are responsible for ensuring you have the right to use and upload all content
  • You are responsible for the accuracy of information your chatbot provides to end-users
  • You are responsible for complying with data protection laws regarding your end-users' data
  • You must maintain an appropriate privacy policy for your own end-users

6. AI-Generated Content

  • Chatbot responses are generated by artificial intelligence and may not always be accurate
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated responses
  • You are responsible for reviewing and monitoring your chatbot's responses
  • AI responses should not be considered professional advice (medical, legal, financial, etc.)
  • We provide tools (instructions, persona, off-topic blocking) to help you control response quality

7. Third-Party Integrations

The Service integrates with third-party platforms including:

  • OpenAI — for AI language processing
  • ElevenLabs — for voice synthesis
  • Meta (Facebook, Instagram, WhatsApp) — for messaging channels
  • Google (Calendar, Sheets) — for scheduling and data management
  • Viber — for messaging

Use of these integrations is subject to each provider's own terms of service. We are not responsible for the availability, performance, or policies of third-party services.

8. Service Availability & Support

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated in advance when possible
  • Customer support is available via our in-app ticket system
  • Response times vary by subscription plan

9. Limitation of Liability

  • The Service is provided "as is" and "as available" without warranties of any kind
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • We are not liable for losses caused by AI-generated content, third-party service failures, or unauthorized access to your account due to your negligence

10. Termination

10.1 By You

You may cancel your subscription and close your account at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.

10.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Fail to pay outstanding invoices after reasonable notice
  • Use the Service in a way that poses a security risk or could harm other users
  • Engage in fraudulent or illegal activities

10.3 Effect of Termination

  • Upon termination, your access to the Service will be disabled
  • Your chatbots will stop responding to end-users
  • You may request a copy of your data within 30 days of termination
  • After 30 days, your data may be permanently deleted

11. Intellectual Property

  • The ChatBotAPP platform, including its design, code, features, and documentation, is our intellectual property
  • The ChatBotAPP name and logo are our trademarks
  • Nothing in these Terms grants you rights to our intellectual property except the limited right to use the Service

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of significant changes via email at least 14 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Serbia. Any disputes arising from these Terms shall be resolved by the competent courts in Belgrade, Serbia.
